The Aurora man who pleaded guilty last year tothrowing an explosive device into a Naperville restaurant in the midst of civil unrest following the police killing of George Floyd in 2020 has been sentenced to five years in federal prison.
A federal judge last week sentenced Diego Vargas, 27, nearly 17 months after he was first charged with a single count of maliciously attempting to damage and destroy a building by means of an explosive device.
According to Vargas’ plea agreement, he threw a street pole through a window of the Egg Harbor Cafe in Naperville on June 1, 2020. He then threw a “lit explosive device” into the building, which caused two explosions, according to the plea.
In his plea, Vargas also admitted that one night earlier, he tried to steal cash from an ATM in Aurora. Vargas worked with two others to try and get cash from the machine, located at a First Midwest Bank, the plea states.
Vargas used a baseball bat to hit the ATM before pulling down a street pole and using that to try and pry the machine open, according to the plea. He and the others also unsuccessfully tried to pull the ATM from where it was anchored down.
At the time, the ATM was holding just over $50,000, while the damage to the ATM totaled $40,000, the plea states.
Federal records indicate Vargas remains held at theMetropolitan Correctional Center in downtown Chicago.
